Bijnor: A special Pocso court in Bijnor has ordered registration of a criminal case against Basic Shiksha Adhikari (BSA) and a retired teacher for allegedly submitting fabricated documents in a rape case. The education department forged papers to show the girl was a minor at the time of the incident. The “accused”, who was acquitted later by the court, then took up the matter.Public prosecutor Bhalendra Singh Rathore said that a rape case was filed in 2021 against a man and his kin under IPC sections 366 (kidnapping, abducting, or inducing woman to compel her into marriage or force her into illicit sexual intercourse), 376-D (gang-rape) and section 6 of Pocso Act.While the court acquitted the accused in 2025, a major discrepancy surfaced regarding the girl’s age. The education department had processed records showing the girl as minor, despite her being an adult at that time.When the BSA was directed to investigate and explain the inconsistencies, their subsequent report was deemed “unsatisfactory”.Judge Kalpana Pandey observed that the teacher (in-charge) produced forged school records before the court, and hence, the court on Friday took a serious view and ordered “a criminal miscellaneous case against both the BSA and the retired teacher”.
The court observed: “Failure to provide a transparent explanation and the deliberate use of false records warranted immediate criminal proceedings against the officials involved.” It added that “judicial integrity will not be compromised by administrative lapses”.
