HC junks plea on AGMUT rules for appointing officers in the IPS cadre

Panaji: The Bombay high court dismissed a petition by citizen Sudip Tamankar, seeking directions to authorities to implement the Arunachal Pradesh-Goa-Mizoram and Union Territories (AGMUT) cadre rules while appointing officers in the Indian Police Service (IPS) cadre in Goa.

Tamankar stated that vacancies meant to be filled by officers of the IPS cadre in various posts within the purview of the AGMUT cadre were being filled by police officers from the Goa state cadre, thus compromising the efficiency and effectiveness of the police department.


The high court observed that Tamankar, who described himself as a public-spirited citizen, raised an issue of violation of cadre rules, which strictly fell within the domain of service jurisprudence.

“However, the petitioner is neither in service nor a former officer of the police department. He also failed to demonstrate in what manner he had the locus to approach this court by filing the present writ petition. In view of the settled law that no public interest litigation (PIL) can be entertained in service matters, and considering the statements made in the petition, we are not inclined to entertain this plea at the instance of the petitioner,” stated the bench comprising Justices Suman Shyam and Amit Jamsandekar.Get the latest lifestyle updates on Times of India, along with Valentine's day wishes, messages and gift idea !
