Prosecution proposes 9 charges against Salman, actor opposes
MUMBAI: The prosecution on Monday filed a list of nine charges it proposes to frame against actor Salman Khan for allegedly killing one person and injuring four in a hit-and-run case even as the star disputed the charge of culpable homicide not amounting to murder, saying it was not applicable to him.
Arguments on proposed charges were on Monday inconclusive and the matter has been deferred till Tuesday. If the plea of the prosecution is accepted, the court would frame charges against the actor or else the charges would be dropped.
Salman urged the court to drop the charge of section 304 part two IPC (culpable homicide not amounting to murder) which is triable exclusively by a court of sessions. In regard to other charges, he did not raise any dispute.
The actor allegedly rammed his vehicle into a bakery at Bandra on September 28 killing Noorulla Mahboob Sharif, who was sleeping outside. Prosecution proposes to charge him with IPC sections 304 part two and 279 (causing death by negligence).
The other proposed charges are section 338 IPC (causing grievous hurt to 17-year-old Abdul Rauf Shaikh), section 337 IPC (causing hurt to Kalim Mohammed Pathan and Munna Malai Khan), 427 IPC (damaging property of bakery), section 134 (A)(B) read with section 187 of Motor Vehicle Act, section three read with section 181 (driving without licence), section 185 (driving under the influence of liquor) and section 66(i)(b) of Prohibition Act.

Salman pleaded that at the most he could be tried for an offence of causing death by negligence which was a less graver offence under IPC than 304 part two. Hence he pleaded that the case be transferred to a magistrate''s court while prosecution said he was fully aware that rash driving would kill people.
