Property fraud: Bizman claims kin fabricated will; SRO among 5 booked

Hyderabad: A 57-year-old businessman approached the Central Crime Station (CCS) police, alleging that his brother, in collusion with other family members and the Doodhbowli sub-registrar, created a fake will in the name of their late father and got two Begum Bazar properties, worth around 20 crore, registered in their favour. Police have booked a case against five accused, including the sub-registrar, and launched an investigation.According to CCS officials, the complainant, Venugopal Toshniwal from Mangalhat, submitted a complaint on May 1, alleging forgery, fabrication of documents and illegal transfer of family properties.In his complaint, Venugopal stated that his father, the late Brij Gopal Toshniwal, purchased a 240 square yard property at Bhaji Mandi in Begum Bazar, along with family members, through a registered sale deed in 2011. He further said his father also owned a 95 square yard property at Nagar Khana in Begum Bazar, purchased through a registered sale deed in 2006.Venugopal told police that his father died on Sept 7, 2012, and never executed any will during his lifetime. He alleged that after his father's death, his brother Umesh Kumar Toshniwal conspired with sister Suman Bang, her husband Giri Raj Bang and the Doodhbowli sub-registrar fabricated a will dated December 9, 2011."Based on the alleged forged will, Umesh Kumar Toshniwal executed gift deeds in favour of his wife Kavita Toshniwal in 2024 and 2025 for both the properties. Also, when I sought a certified copy of the will through an RTI application, the sub-registrar's office replied that the document was not available," the complainant alleged.On Venugopal's complaint, the CCS police registered a case under Sections 318(4) (Cheating and dishonestly inducing delivery of property), 338 (Forgery of valuable security, will, etc), 340(2) (Using as genuine a forged document or electronic record) read with 61(2) (Criminal conspiracy) of the Bharatiya Nyaya Sanhita (BNS) against Umesh Kumar Toshniwal, Kavita Toshniwal, Suman Bang, Giri Raj Bang and the Doodhbowli sub-registrar. CCS police said that they were collecting evidence and the case was under investigation. No arrests have been made yet.
