Sunil Nayak, who was on deputation to Andhra Pradesh, worked as Deputy Inspector General (DIG) in the CID.

Sunil argued in his petition that the case was politically motivated, and he had no connection with the alleged torture. He stated that his name was not in the FIR and was included later. The witness statements revealed that he was present at the time of the alleged incident, but no one said that he tortured Raju.Sunil further submitted that his anticipatory bail was earlier rejected by the trial court and that he apprehended arrest in view of the latest attempt made by the police. He sought interim protection from arrest pending disposal of the petition.
