High Court rejects judicial probe into medical aspirant’s death
In a significant ruling, the Patna High Court has turned down a father's request for an independent judicial inquiry into the enigmatic death of his child, a medical aspirant. The court emphasized that the state's move to involve the CBI in the investigation negates the need for high court oversight at this moment.
Patna: Patna high court on Monday refused to entertain a plea filed for an independent judicial probe, conducted by a retired Supreme Court or high court judge, into the suspicious death of a medical aspirant in Patna on Jan 11.A single bench of Justice Arun Kumar Jha while disposing of a criminal writ application filed by father of deceased aspirant passed this order. It observed that since the state govt has decided for a probe into this by CBI hence at this stage there is no requirement of any intervention by the high court.

The writ petitioner has also prayed for a high court’s direction to provide security to the entire family of deceased medical aspirant by Patna police. He alleged that the special investigation team (SIT), constituted by the state govt, instead of arresting the culprits are harassing the family of the girl.State counsel Kinkar Kumar opposed the writ petition and submitted to the court that victim’s father has filed this criminal writ at premature stage.
