Court rejects anticipatory bail for accused involved in illegal medicine trading case
Kanpur: Additional district and sessions judge, Kanpur Nagar, Azad Singh on Monday dismissed the anticipatory bail application of Anmol Gupta, an accused in the alleged illegal trading of Codeine, Tramadol and Alprazolam medicines.
Drug inspector Om Pal Singh on November 24, raided M/s Medicina Health Care and its partners, Anmol Gupta and Shivam Agarwal, and lodged an FIR at the Collectorganj police station alleging that the firm was involved in illegal trading of Codeine medicine.
The assistant commissioner (Drug) had inspected the firm on June 28 in the presence of Anmol Gupta and observed that it was buying and selling Codeine, Tramadol and Alprazolam medicines.
Gupta in his anticipatory bail application said that the licence of his medical firm was cancelled on September 4, the FIR lodged on November 24, was fabricated, and he feared arrest despite being innocent.
ADFC Vinod Tripathi argued that the FIR was registered against Anmol Gupta alleging that the medicines purchased and sold by the accused were being misused as drugs, and many children had died in several states due to the use of Codeine. He added that as the accused had committed a serious crime therefore it is not a fit case for granting him bail.
The judge in his order noted that the investigation is still underway and that no evidence has emerged to show that an attempt is being made to arrest the accused merely to cause him physical or mental harm. He said that the sections listed are punishable by life imprisonment and that there exists no ground in the accused's arrest. In these circumstances, the anticipatory bail application is dismissed.
