JMC chief’s chair attached over 13-yrs delay in HC compliance

Jaipur: Acting on a court order issued earlier this week, attachment proceedings against the Jaipur Municipal Corporation commissioner’s chair were carried out Friday over JMC’s failure to comply with a 13-year-old Rajasthan High Court order.

The action stems from the Chandrakant Nagar versus JDA, JMC and others case, in which the ACJM-1 Jaipur Metropolitan First Court on May 20 directed attachment of the commissioner’s chair after finding prolonged non-compliance with judicial directions related to the issuance of an allotment letter.

Following the court’s order, court amin Babulal Sharma, decree-holder Rashmikant Nagar and advocate Sanjay Sharma reached the JMC headquarters Friday and initiated attachment proceedings inside the commissioner’s office.

The matter pertains to a 150-square-yard land allotment dispute dating to 1995. On Sept 26, 2013, the Rajasthan High Court directed JMC to issue an allotment letter to the petitioner. However, despite repeated reminders and dismissal of the corporation’s appeal before the High Court, the allotment letter was allegedly not issued.

Advocate Sanjay Sharma said more than 20 reminders were served on the corporation over the years, and the decree-holder deposited the required bank guarantee. Despite this, no further action was taken by the civic body.

During Friday’s proceedings, the court team pasted an official notice on the commissioner’s chair, sealed it and later removed it from the office as part of the attachment action.

JMC officials sought two to three days’ time from the court team and assured compliance with the High Court directions. However, the request was declined, and the attachment proceedings continued.

The matter is scheduled again on May 27, when the court is expected to review the corporation’s compliance status and decide on further proceedings.
