Hyderabad: Telangana High Court has refused to interfere in the appointment of
M Kodandaram and Mohammed Azharuddin as Members of the Legislative Council (MLCs) under the Governor's quota, noting that the issue is already pending before the Supreme Court of India.
Justice Nagesh Bheemapaka was hearing a petition filed by Syed Hyder Raza Naqvi of Hyderabad, challenging a government order on April 26, nominating them as MLCs.
During the hearing, the petitioner's counsel argued that the government order lacks clarity on the pending Special Leave Petition before the apex court on appointment of MLCs under Governor's quota.
The counsel argued that the GO has been issued deliberately, despite the matter already before the apex court for adjudication.
The Judge asked the petitioner's counsel how he had filed a fresh petition before the high Court when the issue was pending before the Supreme Court.
He emphasised that once the matter is seized by the apex court, the High Court would not be in a position to adjudicate on the same issue again.
