“No ground made out”: Court dismisses contractor’s anticipatory bail plea in Janakpuri biker case
New Delhi: In an order denying anticipatory bail to contractors Himanshu Gupta and Kavish Gupta in connection with Janakpuri pit death case, a Delhi court observed that their custodial interrogation was necessary, given the gravity of the offence, which could not be ignored.Additional Sessions Judge Harleen Kaur noted the requirement of custody, considering that "the possibility of the contractor trying to influence material witnesses or other persons associated with the case, or to tamper with the documentary or other evidence, cannot be ruled out at this stage."
"The FIR stemmed from the unfortunate death of a young boy in his 20s," the court commented, taking into account the prosecution's allegation that the incident resulted from the accused contractor's failure to undertake adequate safety measures at the excavation site.The prosecution submitted that Gupta joined the investigation on Feb 12, 14, and 17 but allegedly gave evasive replies and failed to furnish relevant documents. It further alleged that he remained in continuous contact with co-accused Rajesh Kumar Prajapati even after the incident.The state also submitted that it was yet to be ascertained whether Gupta obtained the necessary permissions, as mandated under the Delhi Jal Board agreement, to dig the "15 ft deep pit", and further expressed doubt over how he executed the contract with the sub-contractor a few months before it was formally awarded to him.Gupta's counsel argued that the DJB approved the work only on Oct 9, 2025, by the time he was already suspended as director due to corporate insolvency proceedings.The court also rejected the regular bail plea of sub-contractor Prajapati. So far, two arrests were made, and three DJB officials were suspended. Prajapati and a labourer, Yogesh, are in judicial custody.
