HC refuses to ban ‘Dhurandhar 2’ screening till polls

Chennai: Madras high court on Friday refused to ban screening of the film ‘Dhurandhar 2' in Tamil Nadu till the Assembly elections are held.The petitioner, advocate Sheela, submitted that the movie had political content that favoured BJP and that this violated the model code of conduct (MCC), which prohibits anything that affects a level playing field and favours a particular party. It also affects the purity of the election process, she said. It is the duty of the Election Commission to ensure a free and fair election, she added. Refusing to allow the plea, the first bench of Chief Justice Sushrut Arvind Dharmadhikari and Justice G Arul Murugan observed that there was nothing in the petition pointing out which content in the film favoured a political party. This apart, the Central Board of Film Certification (CBFC) has granted a certificate for screening of the film; therefore, the court cannot interfere with the same, the bench added.The certificate is not under challenge. Unless the certificate is set aside, screening of the film cannot be prohibited, the court said. "CBFC is a statutory body. Once the body has issued a certificate for screening, we cannot interfere unless it is challenged," the judges said.
