Karnataka Hijab Row Updates: Classes 9, 10 to reopen from Monday, decision on seniors and colleges later

The three-judge bench of the Karnataka high court has begun hearing the petitions questioning the ban on wearing of 'hijabs' (headscarves) by students in colleges. Chief Justice of HC Ritu Raj Awasthi has constituted a full bench comprising himself, Justice Krishna S Dixit and Justice Jaibunnisa M Khazi in view of the urgency to hear the matter. Meanwhile, the Supreme court on Thursday declined to urgently list a plea seeking transfer of the petitions from the high court.

‘No girl child should be deprived of education'
Senior advocate Sanjay Hegde, appearing for petitioner-students from a Udupi college, submitted that the students have only two months left in the academic year. "The problems arise from Udupi, my hometown. Is there a power to prescribe a uniform? What is important is these students return back to colleges. No heaven will fall in two months. No girl child can be deprived of education," he submitted.

This matter was very passionately argued yesterday by both sides for some time, from which the judge has benefited. Regarding the enormity of the importance of the questions that are debated, the court is of the considered opinion that the papers be put at the hands of honourable Chief Justice to consider if a larger bench can be constituted in the subject matter.

The judge has passed an order for placing the matter before the high court chief justice to consider constituting of a larger bench. During the hearing ,the judge said that in matters of personal laws, it is the practice to a constitute larger bench to decide the matters.

Where there is a prescribed uniform in schools/colleges, it should be followed. Only education should be the focus at centers of education. Religious or political issues should not be brought to schools/colleges
