Gujarat HC grants bail to GujCTOC accused, cites delay in trial
Ahmedabad: The Gujarat high court on Thursday granted regular bail to an accused booked under the Gujarat Terrorism and Control of Organised Crimes Act (GujCTOC), with conditions, citing delay in trial.Veraval police had booked the accused under GujCTOC in connection with seven cases of bootlegging and gambling. He sought bail from the high court through advocate Vishvesh Acharya, arguing that he has been languishing since Nov 2025. He has never been booked in any case showing he was part of a syndicate or involved in organized crime.The state govt opposed the plea, stressing the seriousness of the charges under GujCTOC. After hearing both sides, the high court noted that the accused had been arrested in Nov 2025 and that the trial would take time to begin and conclude.Referring to the right to speedy justice under Article 21 of the Constitution, the court said, "...and therefore, considering the right to speedy justice as enshrined under Article 21 of the Constitution of India, in howsoever serious offence or under the special Act an accused is involved, on the ground of delay in trial, the accused is entitled to be released on bail without further discussing anything on merits."The court also barred the accused from entering Gir Somnath district for six months.
