Supreme Court Questions CEC Appointment Process, Raises 'Independence' Concerns

The Supreme Court has raised concerns over the current selection process for appointing the Chief Election Commissioner and Election Commissioners, questioning the inclusion of a Union cabinet minister in the selection panel. The bench observed that the panel, which currently includes the Prime Minister, the Leader of Opposition, and a Union minister, may not ensure true independence, as decisions could effectively be reduced to a 2:1 majority where the minister is unlikely to differ from the Prime Minister’s view. The court questioned the need for such a structure, remarking on the importance of maintaining independence in the appointment process. It further said that if the Chief Justice of India can be part of other key appointment processes, a similar independent mechanism could be considered for the Election Commission. The court stressed that the poll body must not only be neutral but also appear to be so.
