Divisions within the family of recently passed Formula One legend Sir Stirling Moss have been laid bare in a new High Court legal battle over his £27.8million fortune. Moss's name has come to epitomise not only sporting greatness and national pride, but also a bitter inheritance battle, notable as much for the magnitude of the estate as for the deeply personal allegations being played out in public in court.The case revolves around a challenge to the last will of Moss's widow, Lady Susie Moss (born Kohner), who died in 2022. The argument puts Sir Stirling's children at loggerheads and involves issues of his testamentary capacity, claims of undue influence, and how the legacy of one of Britain's greatest motorsport icons should be ultimately preserved.

Legal battle over Lady Susie Moss’s final will

The proceedings will be made by Lady Susie Moss in January 2022 when she left her entire residuary estate of some £27.8 million to her daughter, Allison Bradley. The document has been challenged in court by Sir Stirling's son, Stirling Elliot Moss, who is seeking a High Court declaration that the will isn't valid.Elliot Moss asserts by way of his claim that the will was procured by undue influence and fraudulent misrepresentation of a third party who apparently convinced Elliot's mother to leave him out of her will. According to court documents, Lady Moss was alcohol dependent and was suffering from depression when her husband, the former racing car driver Sir Stirling, died in 2020, and this, he maintains, would have impaired her ability to make sound decisions when dealing with her estate.
Elliot Moss is seeking to reinstate an earlier will, dated 2002, which he says more accurately reflected the long-standing intentions of both parents and would have resulted in a different distribution of assets.

Sir Stirling Moss’s legacy and family divisions

More than just the financial numbers, the case has revealed profound emotional divisions in the family. Among the items in question are various personal belongings associated with Sir Stirling Moss's racing career, some of which are tied to significant memories. But court documents don't describe the items as just property; they are trophies, reminders of an intimate link with one of sport's greats.In a statement, Lady Susie Moss's lawyers said Ms Bradley is expected to contest the allegations 'vigorously' and that the widow acted voluntarily and with 'full knowledge' of the contents of her last will.
