Maharashtra CM Uddhav submits resignation to governor after SC refuses to stay floor test
Maharashtra chief minister Uddhav Thackeray on Wednesday resigned ahead of floor test tomorrow. The Supreme Court rejected Uddhav government's plea and refused to stay the floor test in the Maharashtra assembly tomorrow. A vacation bench of Justices Surya Kant and J B Pardiwala heard arguments on behalf of Shiv Sena, its rebel MLAs led by Eknath Shinde, and the Governor on the plea in the hearing conducted after 5 pm through hybrid mode. When speaker decides that a person is disqualified, they cannot be treated as members from inception, from the date when the disqualification petition is filed. This has been held time to time by Supreme Court

Justice Kant: This is a case, where the Speaker has taken a conscious decision, and the challenge to the same is pending before the courts. But then in case where Speaker has been approached with disqualification and no decision has been taken, will it be disqualification?
The fact that the court has stopped that (disqualification) process, the persons who are facing that are taking advantage of the same. They have disqualification proceedings stayed against them and then they are protesting. That cannot happen, Singhvi said.

There is supersonic speed for the Floor Test. The Floor Test determines which govt represents the will of the people. A Floor Test is supposed to find out the true majority. True majority will include those eligible to be included, he said.

The Supreme Court on Wednesday agreed to hear at 5pm a plea of Shiv Sena chief whip Sunil Prabhu challenging the Maharashtra Governor's direction to the Uddhav Thackeray-led Maha Vikas Aghadi (MVA) government to take floor test in the Assembly on Thursday.
