Kulbhushan Jadhav case: What the ICJ said in its verdict

1. Both India and Pakistan agree that Kulbhushan Jadhav is an Indian citizen

2. The circumstances of Kulbhushan Jadhav' s arrest remains disputed

3. India should have been given consular access as per

Vienna convention



4. The court considers it has prima facie jurisdiction in the case

5. The court is not called upon at this point in the proceedings to determine definitively whether the rights India wishes to see protected exist. It need only decide if these rights are plausible.

6. Pakistan's arguments do not provide a sufficient basis to exclude the plausibility of the rights claimed by India. Rights invoked by India under the Vienna Convention are plausible

7. Court concludes the conditions required to indicate provisional measures are met. Certain measures must be indicated to protect the rights claimed by India.

8. Court orders that Pakistan take all measures at its disposal to ensure that Mr Jadhav is not executed pending its final order

9. The court reaffirms that its orders on provisional measures have binding effect and thus create international legal obligation for any party to whom the measures are addressed

10. The court unanimously indicates the following provisional measures: Pakistan shall take all measures at its disposal to ensure that Mr Jadhav is not executed and inform the court of all the measures taken in the implementation of said order; until the court delivers its final decision, it shall remain seized of the matters of this order
