CHENNAI: Kanchi junior Shankaracharya Vijayendra Saraswathi would not be arraigned as an accused in the Radhakrishnan assault case, Tamil Nadu Public Prosecutor K Duraisamy informed the Madras High Court on Friday.
He made the submission when an anticipatory bail application filed by the Junior Seer apprehending arrest in the case came up for hearing before Justice M Thanikachalam.

Recording Duraisamy''s statement, the judge observed that the apprehension of the petitioner that he would be taken into custody for non-bailable offences in connection with the case "appears to be misconceived and hence the petition is dismissed".
Vijayendra Saraswathi, lodged in the Central Prison since his arrest in the Sankararaman murder case on January 10, had filed the petition on Jaunary 27 seeking anticipatory bail in the case relating to the assault of former Kanchi mutt associate Radhakrishnan in 2002.
Kanchi Shankaracharya Jayendra Saraswathi was arrested in the assault case besides the Sankararaman murder case and later granted bail.
