India on Friday sought an independent investigation into the alleged extrajudicial killings of four under—trial prisoners by the Hyderabad police. The four had been arrested a day earlier and were accused of raping and murdering a 25-year-old veterinarian.


“Extrajudicial killings are not a solution to preventing rape,” Avinash Kumar, AII executive director said. “The reported delay in filing the First Information Report by the Telangana Police in this case coupled with the shoddy investigation and the general low conviction rate for those accused of rape raises deeply disturbing questions about the state of justice in India," said Kumar in a press statement.

The incident occurred when the state police had taken the under-trials to the site where rape had been committed as part of the investigation. The state police have alleged that the under-trials snatched the police firearms, attacked the police officials and tried to flee, which led to the police firing at the under-trials and subsequently killing them.

, extrajudicial, arbitrary or summary executions and enforced disappearances are strictly forbidden. The International Covenant on Civil and Political Rights, to which India is a party prohibits arbitrary deprivation of life and guarantees the right to a fair trial. Moreover, the UN Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions require that “[t]here shall be thorough, prompt and impartial investigation of all suspected cases of extra-legal, arbitrary and summary executions, including cases where…reliable reports suggest unnatural death in the above circumstances.”

“In a modern and rights-respecting society, using extrajudicial executions to offer justice to victims of rape is not only unconstitutional but circumvents the Indian legal system and sets a grossly wrong precedent. An independent investigation is essential,” said Avinash Kumar.

It is most regrettable that rather than holding the police responsible for the systematic and planned execution of the four rape-accused through extra-judicial killing by an encounter, people have been adulating and venerating the police. If this be the nature of acceptable mode of justice by the public based on emotion and sentiment, then based on that very same mindset, up to 1 lakh registered cases of rape must be justified with execution of assailants through police encounters since the cases have not seen the light of day in judgments. 28,750 registered cases of rape are in the trial stage and 1,35,631 cases are pending hearing. According to NCRB data, 80% of cases do not reach the courts. In our country where every 15 minutes, a case of rape is registered in the country not to mention those cases which remain unaccounted for, and in a country where almost 40% of sitting MLAs and MPs are charged with sexual violence and where 4 sitting MPs are charged with rape, are we to systematically execute these individuals through encounters too! In the past 36 hours alone, cases of rape have been reported from Malda, Guwahati, Mohali, Jaipur, New Delhi, Agra, Thiruvannatapuram, Kota, Unnao, Sitapur, Rajkot, Dwarka, Vijaywada, Coimbatore and Aurangabad with 189 accused being identified, and all of these crimes have occurred almost after the action of the extra-judicial killing through encounter in Hyderabad, and for all those who are fooled to believe that the encounter would have solved the satanic evil of rape, let me remind them that so far, three MLAs from UP are charged with rape but the victims have either been killed or arrested for planted cases of extortion by their assailants. Don’t these criminals need to be shot in encounters too according to the public who feel that justice has been meted out in Hyderabad! Have we become so blinded with sentimentalism, that we fail to appreciate that justice must be carried out through judicial means and not through extra-judicial instances of premeditated execution through encounters. By adulating and venerating the police for having committed a premeditated barbaric crime of extra-judicial murder, we have only further emboldened the police to continue their evil design of taking law into their own hands. Will the public seek the sentence of death by encounter for the MPs, MLAs and Bollywood celebrities against whom the charge of rape has been made!! Do they have the guts to demand the same system of “kangaroo court” justice that they are celebrating for the execution of the four unknown members of the lowest rungs of the society for the political officials and celebrities for the same type of crime?
