Subclass 500 visa denied in Australia? What Indian applicants need to know about the genuine student rule

An Indian student's recent post on Reddit has once again sparked the spotlight on Australia's stricter assessment criteria under the Subclass 500 student visa category. The young man in his mid-twenties, who had obtained a Bachelor's degree in Computing and Software Systems from the University of Melbourne and had worked in Australia for more than four years afterward, revealed that his fresh application for a Subclass 500 visa was denied in January 2026.

According to the refusal letter, authorities were not satisfied that he met the “Genuine Student” requirement. His case has sparked discussion among Indian students who plan to return to Australia for higher studies after completing earlier degrees or work visas.

What is the Genuine Student rule?

Australia replaced the earlier Genuine Temporary Entrant (GTE) requirement with the Genuine Student (GS) rule in 2024. The focus is now more sharply placed on whether an applicant’s primary intention is to study.

The visa officers evaluate academic progress, the relevance of the chosen course, the applicant’s immigration history, financial ability, and future career plans. They also consider whether the chosen course is a logical extension of the applicant’s previous education and whether the applicant’s reason is consistent with their long-term plans.

In the Reddit case, the student had earlier studied and worked lawfully in Australia. However, after going back to India, he managed to get admission into a Master of Artificial Intelligence program at RMIT University and applied offshore. Although he had been compliant in the past, his visa application was rejected since the authorities did not believe that the new application satisfied the Genuine Student requirement.

Why past compliance does not guarantee approval

A large number of students believe that obtaining a degree and working in Australia on a legal basis makes a future application stronger. However, it has become harder for migrants, especially applicants who want to get the second qualification, to obtain visas.

Australia has made its visa checks stricter, especially for students who want to study a second course. Officials now look very carefully at these applications. They try to understand whether the new course is truly needed for the student’s academic or career growth, or if the student is applying mainly to stay longer in Australia.

If the reason for re-applying to study is not clearly explained and supported by evidence, then the applicant’s application may be refused, despite the applicant having previously adhered to visa requirements.

This is because applicants need to submit a clear academic and career strategy, explaining how the new qualification fits into their overall career objectives.

What happens after a Subclass 500 refusal?

In offshore cases, there is no option for merits review. Applicants are required to reapply with better documentation or look for other visa options.

In his post, the student also expressed concerns about accessing personal items of value stored in Melbourne and superannuation withdrawal. Temporary residents who permanently depart Australia can apply for a Departing Australia Superannuation Payment, although taxes apply.

Experts advise students to carefully analyse the refusal letter before taking further steps. A rushed reapplication without addressing the core concerns often leads to repeated refusals.

Australia remains a popular study destination, but visa scrutiny has intensified. The Genuine Student rule requires clarity, consistency and credible academic reasoning.

For Indian applicants, especially those who have previously studied or worked in Australia, it is important to demonstrate strong academic progression and realistic career outcomes. A prior stay in the country does not automatically translate into future visa approval.
