Vijayawada: The high court on Friday declined to grant interim relief to Ananta Lakshmi Durga, wife of YSRCP MLC Ananta Uday Bhaskar (Babu), in the petition filed challenging the trial court order dismissing the discharge petition filed in the driver Subrahmanyam murder case. The high court directed the police to submit details and issued notices to V Nukaratnam, mother of Subrahmanyam, and posted the matter for further hearing on April 23.
Durga moved the high court contending the dismissal of her discharge petition seeking to remove her as accused in the Subrahmanyam case. Arguing on her behalf, senior counsel C Raghu said that the trial court did not mention reasons for dismissal of the discharge petition.
He said that the forensic science laboratories in Chennai and Amaravati gave similar opinions stating that they could not identify who was there with Ananta Babu as seen in the CCTV footage. However, the Central Forensic Lab in Hyderabad gave a contradictory report stating that the person with Ananta Babu is similar to the petitioner. The trial court took it as the basis and dismissed the discharge petition, he said.
Raghu further said that there was no clarity as to which photographs were used to compare the footage. He said that the forensic lab at Mangalagiri sent the photographs to the central lab. As two reports are in favour of the petitioner, Raghu sought interim directions not to frame charges against Durga pending disposal of the petition.
Arguing on behalf of the police, the assistant public prosecutor sought time to submit details as the case came for hearing for the first time. Considering the submissions on both sides, the high court posted the matter for further hearing on April 23.
