VARANASI: The court of additional district judge-IX, Anuradha Kushwaha, on Monday issued notices to defendants in the revision petition filed by a lawyer Harishankar Pandey, that seeks filing of a case against SP chief Akhilesh Yadav, AIMIM chief Asaduddin Owaisi besides others for their alleged remarks on the purported ‘Shivling’ found in the Gyanvapi mosque compound and alleged dirtying of its ablution pond by visitors.
Pandey said, “After the court of additional chief judicial magistrate-V (MP-MLA) Ujjwal Upadhyaya rejected my petition on February 15, I filed a revision petition in the court of the district judge.
From the district judge court the revision petition was transferred to the court of ADJ-IX. The court started the procedure of hearing the revision petition and served notices to all defendants. The court has fixed April 14 as the next date for hearing in this case.”
Pandey had filed this petition in ACJM-V court on May 23, 2022, mentioning that when the court-mandated survey in the case Rakhi Singh vs state of UP and others was completed and a ‘Shivling’ was found in the ablution pond of Gyanvapi mosque on May 16, 2022, and later the court commission report was submitted before the district judge court on May 19, 2022, he was upset to see that Hindu sentiments were hurt by the practice of namazis like spitting and washings hands and legs in the ablution pond.
“Not only this, but in television shows and social media, Akhilesh, Owaisi, his brother and many others were making objectionable remarks over the ‘Shivling’, which were also hurting the sentiments of Hindus.
In view of this, I had moved an application before the ACJM-V court demanding filing of case against the politicians and people associated with Anjuman Intezamia Masajid — the Gyanvapi mosque management committee — including its president Maulana Abdul Waqi, joint secretary Saiyyed Mohammed Yasin and Mufti-e-Banaras Maulana Abdul Batin Nomani,” he said.
