Gujarat: Surat court refuses to release seized passport to accused for Dubai trip

, as he did not provide the travel tickets and travel plans of

Dubai trip

while applying for the release of the seized passport.

As per the case, a case was registered against businessman Vijay Thummar, a resident of

Nava Naroda

in Ahmedabad, in

Varachha Police Station

of Surat in 2018 under Sections 406, 420, 120B, 114 of Indian Penal Code and subsequent to his arrest, he was released on anticipatory bail by Gujarat High Court in August, 2018.

As per one of the conditions of the bail order, the accused had deposited the passport with the Varachha Police Station and at present the passport is deposited in the trial court. Accused’s advocate argued that Vijay Thummar is required to go abroad to Dubai for business purposes from January 25 to February 10, 2021 and he shall adhere to all or any conditions that may be imposed by this court and shall surrender his passport after the completion of work. Additional public prosecutor V C Panchal objected to the plea and argued that if the application is allowed, then there is possibility of the accused fleeing away from trial.

“From the perusal of documents submitted by the accused, no details or copy of the travel tickets or travel plan for the business trip is produced on record in support of the present application. In view of the above, this Court is of the view that in the absence of any documents to show details or copy of the travel tickets or travel plan for the business trip on record in support of the present application, there appears no sufficient reason to allow the present application,’‘ court observed.
