HC flags ‘transfer as deputation’, stays order
Raipur: The Chhattisgarh high court has observed that the transfer of two prosecution officers to the Economic Offences Wing (EOW) and Anti-Corruption Bureau (ACB) appears to be a transfer and not a deputation, raising questions over due process.Hearing two writ petitions, Justice Parth Prateem Sahu noted that deputy director prosecution Vivek Tripathi and assistant director Kunwar Ratnesh Singh were moved from the Directorate of Prosecution to a different department without a valid deputation order. The court said the March 24, 2026 order "appears on the face of it" to be a transfer.HC allowed the petitioners to submit fresh representations within two weeks and directed the state to decide them within six weeks. It also stayed the operation of the transfer order until a decision is taken.
