HC allows cop to appeal transfer to Naxal area after past injuries
Raipur: The Chhattisgarh high court permitted a police constable to submit a formal representation against his transfer to a Naxalite-affected area in Bijapur district. Justice Parth Prateem Sahu disposed of the petition on March 13 and directed the state authorities to decide the matter within three months.The petitioner, Dinesh Ogrey, a constable with the 2nd Battalion of the Chhattisgarh Armed Force (CAF), challenged his transfer from Naya Raipur to the CAF camp in Bechapal, within the Mirtur police station limits of Bijapur.Counsel Abhishek Pandey, appearing for the petitioner, submitted that Ogrey previously served in Naxal-hit regions and sustained injuries during an encounter. The counsel argued that the constable continued to suffer from the effects of those injuries, making the current posting in a high-risk zone difficult for him.While the petitioner already joined his new post in compliance with the orders dated 20 January 2026, he sought the court's intervention to allow a departmental appeal on medical and safety grounds. The state counsel raised no objection to the limited prayer for a departmental review.Consequently, the court permitted Ogrey to file a representation before the additional director general of police (ADGP) administration and the ADGP (CAF) at the police headquarters in Raipur.The court instructed the authorities concerned to consider the constable's past injuries and take a final decision on his posting at the Sakri headquarters in Bilaspur within the stipulated 90-day period.
