Conduct inquiry in missing answer booklet case: HC

PATNA: The Patna high court on Friday directed the Bihar School Examination Board (BSEB) director to initiate an in-house inquiry into the issue of missing answer sheets of a candidate during the intermediate examination of 2020 and his debarment from the examination following the incident.

Terming the barring of the candidate and petitioner, Raman Kumar of the Bhagwanpur inter-college located at Gogri-Jamalpur of Khagaria, as "uncalled for", a single bench of Justice Rajeev Ranjan Prasad heard the writ petition in this regard and gave its verdict on Wednesday. It was made public through the high court website on Thursday. In his verdict, Justice Prasad said whoever is found guilty in the case after the inquiry should be held accountable and initiate action against him or her.

The judgment also said the BSEB's order to bar the candidate is illegal as he was not given prior notice and not allowed to defend himself, thus violating the principles of natural justice.

Quashing the BSEB order, the judge said the verdict was passed to absolve the petitioner from stigma in future or a blot in his career. It added that the petitioner has undergone enough suffering and left the option of awarding compensation open.
