Noida: After ten years, the district and sessions court has acquitted a man accused of murdering his wife in the Yaqubpur village in Noida Phase 2.
Sukhvir Nagar, the additional district government counsel, Gautam Budh Nagar, said that on November 18, 2011, Amit Bhati, then 30, filed a complaint at the Phase 2 police station, claiming that he and his wife, Usha Bhati, then 28, were sleeping in a room when he heard two gunshots and woke up to find his wife injured.

“The house main door was locked from outside, and it appeared someone locked it after committing the crime,” Amit had said in his police complaint. He had raised an alarm, and a neighbour, Raja, had reached the spot and opened the door. Usha was rushed to a private hospital, where she died. The next day, Amit informed the police and registered a case against an unknown person.
Police, however, suspected that Amit killed his wife and filed a false complaint. Later, Amit was made an accused in the case and arrested. During his trial, police told the court that Amit admitted to having killed his wife for rebuking him when he asked her to serve dinner.
However, in the court, the accused denied giving such a statement to police. Dr Anurag Yadav, who performed the deceased’s post-mortem, said that the woman had ruptured lungs, injuries to the heart and blood clotting in the body. A bullet was also found stuck in her abdomen.
Some witnesses, including Raja and Amit’s parents, also recorded their statements in court. Raja said he was sleeping in his room when he heard gunshots. “I rushed towards Amit’s house and found the door bolted from outside. Two suspects were fleeing from the spot. I opened the door and found Usha injured,” he said. Amit’s father Ramesh told the court that he suspected someone else murdered Usha, not Amit.

Ved Prakash Verma, additional sessions judge, Gautam Budh Nagar, on April 28, acquitted Amit of murder charges. “The prosecution lawyer has failed to establish Amit’s involvement in his wife’s murder, and hence, he is acquitted under sections 302 (murder) and 201 (causing disappearance of evidence of offence) of the IPC,” the court said.
