MUMBAI: The Bombay high court, in an interim order on Wednesday, stayed a magistrate court's order granting bail to Thane-based builder Rashmikant Shah. The order was given out following an application filed by the state, seeking the cancellation of the bail granted to Shah.
Vacation judge Justice Mridula Bhatkar has slated the matter for further hearing for June 1.
Shah is named in an alleged case of fraud to the tune of Rs 80 crore lodged against him by another builder, Mahendra Shah. He was apprehended by the police on May 12 at the Chhatrapati Shivaji International Airport.
Shah was granted bail by the magistrate's court on May 14, following which the state moved a plea invoking the powers of the high court to pass orders under Section 482 of the Criminal procedure Code. A Supreme Court quashed the HC's order granting stay, but remanded the matter back to it. Subsequently, the state moved a fresh application under Section 439 (2) of the CrPc, which gives powers to the HC to cancel bail granted to an accused. Shah is currently admitted to J J hospital with chest pain.
