File FIR against man who tried to usurp from mother: HC to police
Madurai: Madras high court has directed the Dindigul district police to register an FIR against a man who filed a habeas corpus petition seeking to find his missing mother, after taking into account the fact that the man attempted to loot the properties from his mother who adopted him.The court was hearing the petition filed by S Selvaganesh. The petitioner claimed to be the adopted son of C Jeyalakshmi, 72, who is a spinster. The petitioner lodged a complaint before the Dindigul Taluk police station stating that his mother was missing from the house since Nov 8, 2025. Thereafter, he moved court. The petitioner stated that Jeyalakshmi was under illegal detention at a home in Theni and that the trustee was extracting money from her.
Police produced Jeyalakshmi before the court. Jeyalakshmi said that she is a spinster and adopted the petitioner as her son in 2021 without knowing about his character. She stated that she owns several properties. Taking advantage of the fact that there was no one to look after her, the petitioner forged her signature and looted her properties.Jeyalakshmi further stated that since Selvaganesh had issued life threats, she went to the home on her own, where she is safe, and not under illegal detention. Jeyalakshmi further stated that she also lodged a complaint before the authorities to cancel the documents that the petitioner dealt with by forging her signature, and also lodged a complaint before the police seeking action against him.A division bench of justice G K Ilanthiraiyan and justice R Poornima observed that the petitioner, after lodging a false complaint, approached the court by filing the habeas corpus petition, and that too by making allegations against the home in which his mother was staying. Taking into account the fact that the woman was not under illegal custody, the judges dismissed the petition and imposed a cost of 1 lakh on the petitioner, payable to the Legal Services Authority attached to the Madurai bench. The judges directed the district registrar of the registration department to take appropriate action forthwith on the complaint lodged by the woman to cancel the documents that the petitioner executed by forging her signature.The judges also directed the police to register an FIR against the petitioner and proceed in accordance with law. The judges further directed police to provide adequate protection to the woman.
