Kanpur: Shivam Mishra, son of a Kanpur tobacco baron, was arrested on Thursday morning in the high-profile Lamborghini crash, and released on a personal bail bond of Rs 20,000 a few hours later.The court of additional chief judicial magistrate (VII), Kanpur Nagar, Amit Singh, noted that police did not obtain prior approval for Shivam's arrest, as required under section 35(6) of CrPC, and denied their request for 14-day judicial custody, citing the procedural lapses.

During the proceedings, the ACJM asked whether the arrest followed the formalities, as required under section 35(6).The prosecution admitted it did not, and said the arrest was based on a tip-off that the accused might flee. The court held that this was a breach of the legal requirements.Shivam was produced before the court following his arrest in the morning near his home, while his lawyer immediately filed a bail application.As a big section of lawyers had abstained from judicial work in response to a call by two advocate associations, which had disrupted the court proceedings, the defence withdrew the bail application. The ACJM said he was only addressing the remand application.
Rejecting the police application, the court released Shivam on furnishing the bond, with the condition that he should cooperate with the investigation and not attempt to influence witnesses.Shivam had been evading arrest in Sunday's Lamborghini crash on Kanpur's VIP road that had left six people injured and damaged several vehicles. According to police, the luxury car, bearing a Delhi registration, was being driven by Shivam. However, his father and lawyers claimed it was his driver, Mohan Lal, who was behind the wheel at the time of the crash.
