BJP spokesperson said that Pathak suffered as he contested against SP leader Dimple Yadav in 2014. Pathak, along with 13 other members of the party, were named under the Gangsters Act, which the court termed as fake and exonerated all.
The court, in its findings, also said the case was registered due to political enmity and held no ground in the eyes of law.
The spokesperson said that the court also held the then government and the local administration guilty of arbitrarily misusing administrative powers, by going beyond the rule to register a case of Gangsters Act against Pathak and others.
“In their testimony to the court, all the witnesses from the minority community testified in favour of the BJP MP and BJP workers. The witnesses told the court that under the pressure of the then government, the police filed fake cases,” the BJP spokesperson said.
The BJP MP’s advocate,
Sharad Mishra
told TOI that due to the pressure of the then government police had registered 12 cases against Pathak and 13 other BJP members, of which only five are pending in the court.
“In other cases all the accused have been absolved of the charges,” said Mishra.
