KOLKATA: The Bengal government on Wednesday moved a division bench of
Calcutta High Court
, challenging the order of a single bench that handed over the Jhalda Congress councillor murder case to the
CBI. The HC will hear the matter next week.
Advocate general S N Mookherjee submitted to the division bench of Chief Justice Prakash Shrivastava and Justice Rajarshi Bharadwaj that the single bench of Justice Rajasekhar Mantha had exceeded its jurisdiction by handing over the Tapan Kandu murder case to CBI. He pleaded that there was no allegation of tampering with the case diary presented to the single bench earlier and argued that police had already arrested four persons.
Counsel for the respondent Kaustav Bagchi drew the attention of the bench to the
FIR
lodged by the victim’s widow that named Jhalda IC Sanjib Ghosh. He contended that the videography of the crime scene was done two days after the incident. The bench adjourned the hearing till April 20.
