Kasba, Topsia residents move HC
Kolkata: More than 10 petitions — affecting over 150 persons — in Topsia and Kasba have been filed before the vacation bench of Calcutta High Court over demolition notices served by Kolkata Municipal Corporation (KMC). The matters will be heard on Friday.Two counsels on Tuesday mentioned the petitions before Justice Partha Sarathi Sen, who gave leave to file the pleas. It will be heard by another vacation bench of Justice Shampa Dutt (Paul) on Friday.Five petitions mentioned by Firdous Shamim dealt with premises in Topsia and Kasba. Another lawyer, Md Zafaryab Jilani, mentioned eight to nine petitions. Some of the petitions were on an apartment in Topsia — which has 13 blocks with some 20-30 flats per block — where it was alleged that Section 400(1) notice had been pasted on a wall there instead of being served to individual flat owners.One of the petitioners of G J Khan Road in Topsia moved Calcutta HC, stating that KMC had issued notice under Section 400(1) of the KMC Act, but in two other persons' names. He is yet to mutate his name as the flat was bought recently. His plea was that since he is the lawful owner, the notice should be issued in his name to give him opportunity of hearing.
