Calcutta High Court
on Monday granted bail to the company’s agent
Amit Banerjee in connection to the case lodged by the Enforcement Directorate. It is the first bail granted by the court in the
Rose Valley Ponzi
firm case.

’s lawyer Milan Mukherjee argued that Banerjee cannot be charged under section 45 of the PMLA Act as he is not accused by the ED under the act. He also argued that had proceeds of crime gone to him, then ED could have attached his properties. He had also argued that while the crime is alleged to have been committed between 2001 and 2008, Banerjee was employed in 2009.
Banerjee’s lawyer Biplab Goswami informed that the court has asked him to submit two sureties of Rs 5 lakh and a cash surety of Rs 1 lakh. He has also been asked not to leave the jurisdiction of Uttarpara police station except for an appearance in the court or ED office.
