Man gets to five years imprisonment for unintentional murder

Kanpur: Special judge (Prevention of Corruption Act) court, Kanpur Nagar on Wednesday sentenced accused Amar Singh to five years rigorous imprisonment along with a fine of Rs 20,000 for committing unintentional murder.

The judge in his order observed that the investigation officer had committed gross negligence in the investigation of the case. He ordered that a copy of this order be sent to the state government, inspector-general of police and district magistrate for action against the investigation officer.

On the quantum of sentence, the defence counsel argued that as the accused is a poor 70-year-old man and working as a priest in a temple, and there is no one to take care of his family, therefore, he should be punished with a minimum sentence.

On the other hand, additional government counsel Shiv Bhagwan Goswami pleaded that the accused had hit on the head of deceased Sitaram unintentionally, therefore, he should be awarded maximum sentence.

The prosecution claimed that the incident had taken place on October 3, 2006. The complainant Pawan Kumar Soni in his FIR stated that a milkman Daddu had asked Sitaram for Rs 180 as payment of milk. His father said that he would pay the money in a couple of days after which Daddu started abusing. During the heated arguments another person Amar Singh intervened in the matter and hit several blows with a thick wood stick. Sitaram fell on the ground and Amar Singh and Daddu both disappeared from the scene. Sitaram succumbed to his injuries at the LLR hospital during treatment.
