Mother-in-law is not eligible for maintenance from daughter-in-law

JAIPUR: The Rajasthan High Court has ordered that a mother-in-law is not eligible for maintenance from daughter-in-law under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act 2007.

The single bench of Justice MN Bhandari order followed a petition by daughter-in-law

Rekha Kumari

who got a government job after her husband’s death against the order of the SDO to pay monthly maintenance of Rs 4,000 per month to her mother-in-law.

She also said she is ready to look after her mother-in-law provided she is ready to move in with her. However, the mother-in-law in an affidavit said she is not ready to live with her daughter-in-law and there is no chance of settlement of dispute between them while the daughter-in-law stated that she is ready to keep and maintain her mother-in-law provided she is ready to live with her and take care of her minor children. The daughter-in-law in her petition said her mother-in-law is a pensioner and has sufficient livelihood means.

The court said as per section 4(1) of the Act only parents and grandparents can maintain against one or more of his children. The daughter-in-law is not considered to be child of the petitioner.
