Indore: The Indore development authority (IDA) cannot do the municipal corporation's work on their behalf in the city as per the constitution, the Indore bench of Madhya Pradesh high court was informed on Wednesday, when the arguments were being made in the petition that sought scrapping of IDA.

Justice PK Jaiswal

and

Justice Virendra Singh

, after which the final order was reserved.

The petition which has been filed by

Manohar Dalal

on behalf of

Keval Yadav

, challenges the constitutionality of the IDA.

In favour of the petition, Dalal argued that as per the town and country planning act of the state, a nominated body cannot use the powers of the elected municipal corporations to carry out development work in the city.

He also gave reference of the Bihar high court's decision of 2005, through which the development authorities of Gaya and Patna were scrapped since they were found unconstitutional.

"The IDA is also unconstitutional, as it is a nominated body and not an elected one. tion," Dalal argued.
