Hearing the petition moved by four out of 30 MBBS candidates that were allotted admission in excess of intake capacity at two private medical colleges, a division bench comprising

Justice PK Jaiswal

and Justice

Virendra Singh

issued notices to state government and DME. and scheduled the hearing on November 4.

Counsel of petitioners, Lalji Tiwari said, "We pleaded before the court that students were not at fault. It was an error committed by DME, which left the students aggrieved."

He added saying that admission of students with lesser score in merit list should have been cancelled as the aggrieved students had other college options at the time of counselling. The petitioners had challenged directorate of medical education (DME) admission process stating that it was unfair and many candidates, lower on merit list, were given admission in medical colleges.

Petitioners had alleged that during the offline counselling held by DME, they could have chosen any of the five colleges.

But, as the private colleges were near to their residence, they chose them. Several candidates with lower ranks were given admission, they said.
