GURGAON: The district town planner (enforcement) has issued a show-cause notice to Orris Infrastructure on March 5 over alleged unauthorised construction at a commercial site located within a residential colony in Sector 89.The notice, issued under Section 10(2) of the Haryana Development and Regulation of Urban Areas Act, 1975, cites alleged deviations from approved building plans at the 3.8-acre commercial site. The developer is accused of erecting concrete pillars, tin sheds, and iron girders in front of shops and in common areas—structures authorities say are not in conformity with the sanctioned layout and violate planning norms.District town planner (enforcement) Amit Madholia said an occupation certificate for the broader residential plotted colony — spread across sectors 89 and 90 and covering over 101 acres — was granted in Nov 2025. However, the recent construction in the commercial pocket is alleged to be in contravention of the approved building and floor plans.“Since we have not received a reply to the notice so far, we are in the process of issuing a restoration order and further action as per the provisions,” Madholia said.
Citing Section 3B of the Act, Madholia said no person was permitted to erect or re-erect any building in a licensed colony except in accordance with approved plans and subject to conditions specified by the govt or competent authority.The department alleged that the additional structures qualified as unauthorised alterations, making the developer liable for action.The enforcement wing has directed the developer to immediately remove the alleged illegal construction and restore the site in line with approved plans.The developer was also asked to submit authenticated copies of the sanctioned building plans and the occupation certificate in support of its case. Failure to comply or provide satisfactory justification may lead to further action, including removal orders and legal proceedings.Officials said the action is part of ongoing efforts to curb unauthorised construction and ensure adherence to planning regulations in licensed colonies across Gurgaon.
