Panaji: Ponda court has directed Ponda police to register a FIR and investigate a complaint of criminal trespass, damage to property, theft and assault over land at Mankem, Shiroda, in June 2024. The court held that upon receipt of cognisable offence, the police cannot withhold the investigation indefinitely on whimsical and frivolous opinions.
Classie Furtado filed a complaint stating that a group of villagers trespassed into her property, damaged solar poles and CCTV cameras, stole memory cards and SIM card, and attempted to cause grievous hurt by throwing stones at her and her family. The mob also threatened them and urged other people to kill them by mass stoning in front of police . She stated that there was no action on her police complaint on June 24, 2024, as well as a supplementary complaint on July 1, adding names of the proposed accused persons.
Both parties are claiming right to the property, with a pending civil suit, the court was told.
Inquiry also revealed that Furtado is claiming rights to property via a deed of gift of 2011 and 2017, and further inquiry revealed that the donor in the deed was not in possession of the property, and the proposed accused allege that the said deed of gift is fraudulent.
