NEW DELHI: Noting that former AAP councillor
Tahir Hussain instigated a mob to indulge in vandalism, a Delhi court has ordered the framing of charges against him, his brother Shah Alam and eight others in a 2020 northeast Delhi riots case.
The court of ASJ Pulastya Parmachala, which discharged three persons - Deepak, Mahak Singh and Navneet - was hearing a case against 13 accused of being part of a mob that looted and torched three shops in Moonga Nagar locality.
The accused were charged under IPC sections 148 (rioting with deadly weapon), 380 (theft in dwelling house), 427 (mischief), 435 (mischief by explosive substance), 436 (mischief by fire) and 450 (house trespass). Hussain was additionally charged with Section 109 (abetment). The other accused are Mohammed Shadab, Riyasat Ali, Gulfam, Rashid Saifi, Mohammed Rihan, Mohammed Abid, Arshad Qayyum and Irshad Ahmed. Except for Hussain, the others were also booked under IPC Section 188.
The FIR was registered on a complaint by Irshad Ali and two more complaints were clubbed. The court took note of statements that said Hussain was roaming on the roof of his house pointing towards some shops, after which the rioters vandalised and set them on fire. "This mob was instigated by Hussain to indulge in vandalism, loot and arson. It attacked nearby properties, including the three in question in this case," the court said on August 5.
