Interim bail for Supertech chairman on med grounds

New Delhi: A Delhi court on Tuesday granted interim bail to real estate tycoon and Supertech chairman RK Arora for a month on medical grounds.Additional sessions judge Devender Kumar Jangala directed Arora to furnish bail bond worth Rs 1 lakh with two sureties in the like amount."The Constitution of India guarantees right to life under Article 21 to its citizens including the prisoners also. The right to health has been declared to be part of Article 21 of the Constitution available to the prisoners also. Article 21 of the Constitution does not become suspended merely because a person is in custody for commission of an offence," said the court.Arora was arrested in June last year by the enforcement directorate based on 26 FIRs registered by the Economic Offences Wing, Delhi Police, Haryana Police and UP Police against Supertech.Arora had moved an application for interim bail for 90 days, stating that his diagnosed disc degenerative disease was showing no improvement despite two months’ treatment, adding 10 kg weight loss along with acute depression medication was causing various side effects such as hallucinations and withdrawals.Opposing the bail, ED submitted that the accused’s medical condition could be treated by jail authorities themselves and that there was no urgent requirement for releasing Arora on bail.Noting that Arora has claimed that his medical report furnished on record is duly supported with the diagnostic report and was futher authenticated by the concerned jail superintendent, the court said that he is suffering from various ailments including the disc degenerative disease (cervical and lumber) and GERD (Gastro-esophageal reflex disease) apart from other illness.The court has imposed various conditions including barring the accused from leaving the NCT of Delhi/country without its prior permission, among others.
