NEW DELHI: Two years after the juvenile justice board inspected the government-run observation home in Majnu Ka Tila and learnt of how the inmates were subjected to physical torture by the staff, the Delhi High Court on Wednesday ordered registration of an FIR against the derelict officials. Criminal division Bench of Justice R S Sodhi and Justice P K Bhasin ordered a police probe into the matter after perusing the entire report and two complaints which were written by the inmates to the board’s presiding officer at that time, Santosh Snehi Mann.
The letters were written subsequent to Mann's report castigating the authorities.The inmates had apparently become victims of the officials'ire as they had dared to complain against them to Mann, when the latter visited the home alongwith another board member. Rajiv Awasthi, who was appointed as the amicus curae in the case said:"The report gave an insight into how a group of boys at the home were locked in isolation and not allowed to meet visitors.
These inmates were those who either protested against the bad quality of food offered to them or had the courage to speak against them. One of them had apparently got a judicial direction from the court to the officials to provide him with a sweater. He was immediately shunted into this isolated dormitory and was not provided with the sweater." The Bench on Wednesday expressed their shock and surprise over the conduct of the officials. At the time of passing the direction, the court also ordered the special committee — formed to inspect the observation home and report on its conditions — to visit Majnu Ka Tila and submit a final report.
Meanwhile, the state government has also proposed to shift the observation home from Majnu Ka Tila to Sewa Kutir in Kingsway Camp. While addressing the court, the state counsel said the construction of the new observation home will be completed within three months. To get apprised about the criminal probe and status of the building's construction, the court fixed December 13 as the next date of hearing. Awasthi said various inspections by the court committee in the past have found that the living conditions inside Majnu Ka Tila were never conducive.
