HC seeks Haryana’s response over delay in prosecution sanction of Delhi cops

CHANDIGARH: The Punjab and Haryana high court on Saturday sought the Haryana government’s response regarding delay in prosecution sanction of Delhi cops, who had allegedly killed a young couple in an ‘encounter’ in July 2014 in Rohtak.


Haryana has already chargesheeted two cops of Delhi Police in the

fake encounter

. However, the trial against them could not be started because of delay in prosecution sanction by the Delhi Police.

Justice Rajan Gupta of the HC asked Haryana to assist the court in the matter and file its response on the next date of hearing on December 10. The matter reached before the HC in the wake of a petition filed by the deceased’s father Satbir Singh.

On July 7, 2014, a team from the Chhawla police station under the Southwest district of the Delhi police had gunned down Raj Kumar, 26, and his fried Jyoti, 36, in an encounter in Rohtak while rescuing Najafgarh-based two businessmen who were allegedly abducted by them for ransom.

In February 2016, the Haryana police had submitted a charge sheet against two head constables — Vijay Singh and Pratap Singh — for murder, causing the disappearance of evidence of offence and various charges under the Arms Act, before district court Rohtak. They had produced a list of 30 prosecution witnesses against these cops along with a chargesheet for the examination during trial of the case.

According to the chargesheet, “Delhi cops could have easily caught Raj Kumar and Jyoti but unnecessarily used firearms on them without waiting for any order from their seniors.” The chargesheet has also indicated that these cops tried to cover up their illegal act after killing the couple.

The state government had also approached the Delhi government seeking sanction to prosecute the cops.

According to the petitioner, despite such a long time, the Delhi government and commissioner of police Delhi had not granted sanction to prosecute the accused cops. The petitioner has sought direction to proceed with trial of the case without further waiting for the sanction and for further investigation to probe the role of other cops involved in the encounter.
