HC warns Bhopal collector over RERA order non-compliance

Bhopal: The MP high court has directed the Bhopal collector to execute an earlier court order within 10 days or appear in court at the next hearing of a contempt petition filed by Bhopal resident Arvind Verma. This is Verma's second contempt petition, as the collector did not comply with the high court's previous directive. Verma, in his petition, said in response to his first contempt petition, the high court had set a deadline of 30 days for the Bhopal collector to execute the Revenue Recovery Certificate (RRC) order passed by the Real Estate Regulatory Authority (RERA). Following expiry of the deadline, he had to file another contempt petition since the order of the high court was not complied with. This despite the fact that the court had said if the order was not complied with within the time limit given and the petitioner files another petition for execution of the order, the collector will personally bear the cost of litigation of both the petitions. Verma said the RERA had issued RRC against the builder concerned in 2020 and asked the Bhopal collector to execute the order for recovery. However, the Bhopal collector didn't do anything for the execution of the order. Following this, a petition was filed in the high court, which asked the Bhopal collector to execute the RERA order within 60 days. When it was not done again, a contempt petition was filed in the high court. The court while disposing of the contempt petition gave the district collector 30 days with a warning that he would be paying the cost of litigation, if the petitioner has to come to court again for non-compliance of the order within the timeline given. The court of Justice AK Singh has now fixed the case for hearing on March 12 with a warning to Bhopal collector to execute the order till then or else be present in the court that day.
