A division bench headed by acting chief justice

H G Ramesh

asked the petitioners to file their amended petition enclosing the challenge to October 31, 2017 order passed by the additional chief secretary (ACS), urban development department. Counsel for the petitioners told the court that the

ACS

, who gave them a hearing on orders from the court, rejected their representation without considering their objections on several key technical aspects emanating from the Indian Road Congress (IRC) guidelines.

Declining to pass any interim order to stall the project, the bench observed that in case it is not as per standards and against public interest/safety, it can be ordered to be pulled down. The petitioners’ counsel said clearance is given for a 4.5-metre flyover which is against IRC guidelines which stipulate a height of 5.5 metre.

Even the gradient is steep as only a 368-metre flyover is being built as against the required length of 468 metres, he added.
