Chikkamagaluru cops vs lawyer: HC disposes of PIL
BENGALURU: The Karnataka high court on Wednesday disposed of a suo motu public interest litigation (PIL) registered in the aftermath of the alleged brutal attack on an advocate by Chikkamagaluru Town police on November 30, 2023, for not wearing a helmet while riding bike.
While doing so, a division bench of Chief Justice Prasanna B Varale and Justice Krishna S Dixit rejected the plea of Vivek Subba Reddy, president of Advocates' Association of Bengaluru, for a directive to arrest the accused police personnel involved in the case. tnn
In his submission, Vivek Subba Reddy said though the probe has been entrusted to CID, the agency, during investigations, is seeking assistance of local police and, hence, a directive needs to be issued for keeping local police personnel away during probe.
He sought a timeline vis-avis completion of disciplinary action initiated against the erring police officers. However, the bench pointed out that all the courts have consistently adopted the view that course of an investigation to be conducted by the investigating agency has to be independent and no court can direct the investigating agency to conduct probes in a certain way
