Allahabad high court
directed the state government on Thursday to submit before it documents on the basis of which two of members of Uttar Pradesh
Higher Education Service
Commission (
UPHESC
) were appointed.
The court asked the additional advocate general, appearing for the state government, to bring the record of file notings prepared while considering the two members — Harvansh and Krishna Kumar — as ‘eminent persons’ and hence eligible for appointment as member of the commission. Hearing a public interest litigation (PIL) filed by Pratiyogi Chhatra Sangharsh Samiti and another petitioner, a division bench comprising Chief Justice Govind Mathur and Justice Vivek Varma fixed November 27 as the date for next hearing.
In the writ petition, the petitioners alleged that the two UPHESC members did not fulfil the minimum qualifications required for appointment to the post. However, they were still appointed as eminent persons for having made valuable contributions in the field of education.
On the other hand, additional advocate general opposed the petition on the grounds that the appointments complied with the law and both members are eligible for the posts.
