While refusing bail to six persons – owner of Superstar Amusement Pvt Ltd Ghanshyam Patel and his son Bhavesh Patel, manager Tushar Choksi, two operators Yash alias Lalo Mahendra Patel and Kishan Mahanty and a helper Manish Vaghela, additional sessions judge V J Kalotara observed that the intention and knowledge that people could be killed were existent among the accused from the beginning, said public prosecutor Sudhir Brahmbhatt.

The court noticed that Yash Patel was not an engineer, yet he signed the maintenance report as an engineer. The operators were not qualified to operate the ride. The name of Discovery Ride was added in the license form at a later stage while obtaining police permission.

The ride was an assembled one. There was possibility of occurrence of accident. “The knowledge and intention is found itself from the fact that the raw material used in preparing the Discovery Ride would result into serious accident, and ultimately it happened,” the court said.

The court also said that the police investigation in this case is in its initial stage and therefore bail cannot be granted to the accused.
