Who is Alina Habba, former Trump advisor who files assault charges against Rep. McIver
Alina Habba, a former legal advisor to Donald Trump and now the interim U.S. attorney for the District of New Jersey, made headlines this week after charging Rep. LaMonica McIver (D-N.J.) with assaulting law enforcement officers at a federal immigration detention center. The incident, which occurred during a congressional oversight visit to the Delaney Hall ICE facility in Newark, has sparked widespread political and legal debate. Habba’s decision marks the first time a sitting member of Congress has been charged by Trump’s Justice Department during his second term in office.
In March 2025, Trump appointed Habba as the interim U.S. attorney for the District of New Jersey. The move raised eyebrows in legal circles, given her partisan background and previous close association with Trump. Critics questioned her ability to maintain impartiality in the role, while supporters praised her for bringing a bold, results-driven approach to federal law enforcement. Her appointment signaled Trump’s continued reshaping of the federal justice system during his second term.
The charges stem from a visit earlier this month in which Rep. McIver, alongside two fellow New Jersey Democrats and Newark Mayor Ras Baraka, attempted to gain access to the ICE detention facility as part of a congressional oversight mission. According to Habba’s office, McIver allegedly resisted and impeded federal law enforcement personnel, actions that led to her being charged with assault under federal statutes. Video footage of the incident shows a chaotic confrontation but does not clearly confirm any physical altercation.
McIver has strongly denied the charges, calling them politically motivated and an attack on her constitutional duties as a legislator. She insisted that her visit was lawful and intended to monitor the conditions at the facility. In public statements and interviews, McIver claimed she never assaulted anyone and suggested that the Trump administration is using the Justice Department to suppress congressional oversight. Democratic lawmakers rallied around her, accusing the administration of weaponizing legal authority for political gain.
This case raises critical questions about the boundaries between legislative oversight and criminal conduct. The Speech and Debate Clause of the U.S. Constitution typically protects lawmakers from legal action based on their official duties. However, that protection does not extend to alleged criminal behavior. Legal experts expect a lengthy court process to determine whether McIver’s actions fall within the scope of her congressional responsibilities or represent a breach of federal law.
Habba’s aggressive pursuit of charges against a sitting Democratic lawmaker may also reflect broader priorities in Trump’s second-term Justice Department. Critics argue that it sends a chilling message to members of Congress who seek to challenge executive authority, while allies view it as a needed assertion of law and order. As the case unfolds, it will likely serve as a touchstone for ongoing debates over political accountability, prosecutorial power, and the future of checks and balances in Washington.
What is Habba’s background in Trump’s legal circle
Before becoming a federal prosecutor, Alina Habba was known for her role as one of Donald Trump’s most vocal and visible legal defenders. She gained national attention during Trump’s legal battles following his first presidency, frequently appearing on television to denounce what she termed political “lawfare” against him. Habba notably defended Trump in the high-profile hush money case involving Stormy Daniels. She served as a legal spokesperson and later took on a formal advisory role within Trump’s legal team, particularly during investigations involving his business practices and political conduct.Appointment as U.S. attorney and shift to public office

Habba is a newer attorney. She has been sanctioned for inappropriate behavior in the courtroom and she was fined a huge fine along with who she was representing. The woman being arrested was man handled by men in a frantic uproar. A smaller woman in a white coat was too. The charges against the mayor was dismissed. Go to tictoc look up this episode.
